Agreement to Terms

Acceptance

By accessing or using the DriftHub website, mobile application, or any associated services (collectively, the "Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the Platform.

Modifications

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or Platform notification. Your continued use of the Platform after such modifications constitutes acceptance of the updated Terms.

Eligibility and Account Registration

Age Requirements

There are no age restrictions for using the Platform; however:

  • Users under 13 years of age must have verifiable parental consent
  • Users between 13 and 18 years must have parental or legal guardian consent
  • Parents or legal guardians are fully responsible for all activities of minor users under their supervision

By allowing a minor to use the Platform, parents or legal guardians:

  • Accept full responsibility for the minor's activities
  • Agree to be bound by these Terms on behalf of the minor
  • Accept financial responsibility for any fees or charges incurred

Account Creation

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

Account Termination

We reserve the right to suspend or terminate accounts that:

  • Violate these Terms
  • Engage in fraudulent or illegal activities
  • Remain inactive for extended periods
  • Provide false or misleading information

Platform Services

Service Description

DriftHub provides:

  • Marketplace: A platform for buying and selling drift cars, parts, and related items
  • Events Hub: Listing and promotion of drift events worldwide
  • SimDrifting: Virtual drifting community and resources
  • Community Features: Forums, comments, and social interaction tools

Service Availability

We strive to maintain Platform availability but do not guarantee:

  • Uninterrupted or error-free service
  • Compatibility with all devices or software
  • Specific availability timeframes
  • Protection against data loss

Marketplace Terms

Listing Services

Sellers may create listings for drift-related products subject to:

  • Payment of applicable listing fees
  • Compliance with listing guidelines
  • Accuracy in product descriptions
  • Adherence to applicable laws and regulations

Listing Packages and Duration

  • Listing duration depends on the selected package
  • Packages and pricing are subject to change
  • Active listings cannot be refunded upon early removal
  • Expired listings may be renewed subject to current fees

Seller Responsibilities

Sellers are solely responsible for:

  • Accuracy of listing information
  • Product quality and condition
  • Compliance with all applicable laws
  • Shipping and delivery
  • Customer service and dispute resolution
  • Tax obligations

Buyer Responsibilities

Buyers acknowledge and agree:

  • To verify product details before purchase
  • DriftHub is not party to transactions
  • All disputes must be resolved directly with sellers
  • To comply with applicable import/export regulations

Prohibited Items

The following may not be listed:

  • Stolen goods or items of questionable ownership
  • Counterfeit or replica items without clear disclosure
  • Items violating intellectual property rights
  • Illegal items or those promoting illegal activities
  • Hazardous materials without proper documentation
  • Items violating export/import restrictions

No Commission or Escrow

  • DriftHub does not take commission on completed sales
  • We do not provide escrow or payment protection services
  • All transactions are directly between buyers and sellers
  • We are not responsible for transaction disputes

Event Listings

Event Creation

Users may create and promote drift events subject to:

  • Payment of applicable listing fees (package-dependent)
  • Providing accurate event information
  • Compliance with local laws and regulations
  • Obtaining necessary permits and insurance

Event Organizer Liability

Event organizers acknowledge and agree:

  • They are solely responsible for event organization and safety
  • DriftHub bears no liability for physical events
  • They must obtain appropriate insurance coverage
  • They indemnify DriftHub from all event-related claims
  • They must comply with all venue requirements and local regulations

Attendee Assumption of Risk

Users attending events acknowledge:

  • Participation is at their own risk
  • DriftHub is not responsible for injuries or damages
  • They should verify event details independently
  • They must comply with event rules and regulations

User Content and Conduct

User-Generated Content

By posting content (including listings, comments, photos, videos, forum posts), you:

  • Grant DriftHub a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content
  • Warrant that you own or have rights to the content
  • Accept responsibility for all content you post
  • Agree content may be removed at our discretion

Content Standards

Users must not post content that:

  • Is false, misleading, or deceptive
  • Infringes intellectual property rights
  • Contains malware or harmful code
  • Violates privacy rights
  • Is defamatory, obscene, or offensive
  • Promotes illegal activities
  • Constitutes spam or unauthorized advertising
  • Harasses or threatens others

Community Guidelines

Users must:

  • Treat others with respect
  • Provide honest and accurate information
  • Report violations of these Terms
  • Not manipulate Platform features or metrics
  • Not create multiple accounts for deceptive purposes
  • Not engage in any form of discrimination or hate speech

Moderation

We reserve the right to:

  • Remove or modify content without notice
  • Suspend or ban users for violations
  • Report illegal activities to authorities
  • Implement automated content filtering

Fees and Payment

Fee Structure

  • Listing fees vary by selected package
  • Event promotion fees vary by package
  • All fees are displayed before purchase
  • Prices are subject to change with notice

Payment Processing

  • Payments processed via Stripe, Paddle, or other designated processors
  • You agree to the payment processor's terms of service
  • We are not responsible for payment processor errors
  • All payments must be made in the designated currency

No Refunds

ALL SALES ARE FINAL. NO REFUNDS OR RETURNS ARE PROVIDED FOR:

  • Listing fees
  • Event promotion fees
  • Subscription services (if applicable)
  • Any other Platform services

Billing Disputes

  • Disputes must be submitted within 30 days
  • We will investigate legitimate billing errors
  • Decisions on disputes are final
  • Chargebacks may result in account suspension

Taxes

  • Users are responsible for their own tax obligations
  • Prices may not include applicable taxes
  • We may collect VAT or other taxes as required by law

Intellectual Property

DriftHub Property

All Platform content, features, and functionality, including but not limited to:

  • DriftHub name, logo, and branding
  • Platform design and layout
  • Text, graphics, and images
  • Software and code

Are owned by DriftHub or its licensors and protected by international copyright, trademark, and other intellectual property laws.

Limited License

We grant you a limited, non-exclusive, non-transferable license to:

  • Access and use the Platform for personal or business purposes
  • Download and print content for personal use
  • Share Platform links

This license does not include rights to:

  • Reproduce Platform functionality
  • Create derivative works
  • Use automated systems to access the Platform
  • Remove copyright or proprietary notices

Trademark Policy

  • "DriftHub" and associated logos are our trademarks
  • Third-party trademarks remain property of their owners
  • No license to use our trademarks is granted without written permission

We respect intellectual property rights. To report infringement:

  • Provide description of the copyrighted work
  • Identify the infringing content
  • Include your contact information
  • Provide a statement of good faith belief
  • Include a statement of accuracy under penalty of perjury

Privacy and Data Protection

Your use of the Platform is subject to our Privacy Policy, which is incorporated by reference into these Terms.

By using the Platform, you consent to:

"AS IS" Basis

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF INFORMATION

No Warranty

WE DO NOT WARRANT THAT:

  • The Platform will meet your requirements
  • Service will be uninterrupted or error-free
  • Defects will be corrected
  • The Platform is free of viruses or harmful components

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • DriftHub shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the fees paid by you in the past twelve (12) months
  • We are not liable for user content or third-party actions
  • We are not liable for loss of profits, data, or business opportunities

Transaction Disputes

We are not responsible for:

  • Disputes between buyers and sellers
  • Quality, safety, or legality of listed items
  • Ability of sellers to sell or buyers to pay
  • Accuracy of listings or user content

Indemnification

User Indemnification

You agree to indemnify, defend, and hold harmless DriftHub, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including attorney fees) arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your content posted on the Platform
  • Any products or services you sell through the Platform
  • Any events you organize or promote

Defense of Claims

We reserve the right to assume exclusive defense and control of any matter subject to indemnification, at your expense.

Dispute Resolution

Governing Law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles, to the extent not preempted by Polish law.

Informal Resolution

Before initiating formal proceedings, parties agree to attempt informal resolution through good-faith negotiation for at least thirty (30) days.

Arbitration

If informal resolution fails, disputes shall be resolved through binding arbitration under the rules of the International Chamber of Commerce (ICC), unless otherwise required by Polish law.

Jurisdiction

Notwithstanding the above, disputes may be brought in the courts of Poland, and you consent to the jurisdiction of Polish courts for any legal proceedings.

Class Action Waiver

You agree to bring claims only in your individual capacity and waive any right to participate in class actions to the fullest extent permitted by law.

SimDrifting Terms

Virtual Services

SimDrifting features are provided for entertainment and community purposes only.

No Competitions or Prizes

  • DriftHub does not organize competitions with prizes
  • User-organized competitions are at participants' own risk
  • We are not responsible for user-organized events

Virtual Content

  • No virtual goods or currency system is provided
  • User-created content remains subject to general content policies

Subscription Services

Future Services

We may offer subscription services in the future, which will be subject to additional terms.

Automatic Renewal

If subscriptions are offered:

  • They will automatically renew unless cancelled
  • Cancellation must occur before renewal date
  • No refunds for partial periods

General Provisions

Entire Agreement

These Terms constitute the entire agreement between you and DriftHub regarding Platform use.

Severability

If any provision is found unenforceable, the remaining provisions shall continue in effect.

Waiver

Our failure to enforce any provision shall not constitute a waiver of that provision.

Assignment

You may not assign your rights under these Terms. We may assign our rights without restriction.

Force Majeure

We are not liable for failures due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters
  • War or terrorism
  • Pandemic or epidemic
  • Government actions
  • Labor disputes
  • Internet or infrastructure failures

Notices to users will be sent via:

  • Email to registered address
  • Platform notifications
  • Website announcements

Notices to DriftHub should be sent to:

Language

These Terms are drafted in English. In case of translations, the English version prevails.

Special Provisions for International Users

Export Controls

Users must comply with all applicable export and import laws and regulations.

Currency

All prices are listed in the designated currency. Exchange rate fluctuations are the user's responsibility.

Regional Restrictions

Some services or features may not be available in all regions due to legal or technical limitations.
